CarePath is a documentation tool, not a healthcare provider. It does not practise medicine, diagnose, triage, prescribe, calculate doses or check interactions, and it never replaces a clinician's own judgment or instructions.

1. 01What belongs to us

   The CarePath application, its interface, copy, illustration style, prompts, models and the name and logo are owned by Artemius Labs LLC and protected by copyright and trade mark law. Your subscription is a licence to use the service, not a transfer of any of it.

   You may not copy, reverse engineer or reuse the software or its assets outside the product, and you may not use our name or logo to suggest a partnership or endorsement without written permission. Referring to CarePath by name to describe what you use is fine.

2. 02What belongs to you

   You keep ownership of your instructions, your documents and your branding, and — to the extent we can grant it — of the comics generated for your organization. The full terms are in section 7 of the Terms. You are responsible for holding the rights to anything you upload.

3. 03Reporting infringement (DMCA notice)

   If you own a copyright and believe material on CarePath infringes it, send a notice to our designated agent at support@carepath.com, subject “DMCA notice”. Under 17 U.S.C. § 512(c)(3) it must include:

   • a physical or electronic signature of the owner or someone authorised to act for them;
   • identification of the copyrighted work claimed to be infringed;
   • identification of the material claimed to be infringing, with enough detail for us to locate it — a share link URL is ideal;
   • your address, telephone number and email address;
   • a statement that you have a good faith belief the use is not authorised by the owner, its agent or the law;
   • a statement, under penalty of perjury, that the information is accurate and that you are authorised to act for the owner.

   Postal notices go to the address at the foot of this page. Notices that omit a required element cannot be acted on; we will say what is missing.

   Misrepresenting that material is infringing carries liability for damages, including costs and legal fees, under 17 U.S.C. § 512(f). Please be sure before you file.

4. 04What we do with a notice

   We acknowledge within 5 business days. On a complete notice we remove or disable access to the material expeditiously — which for a shared comic means revoking its links — and notify the organization that posted it, with a copy of the notice.

   Because comics are generated from clinicians’ own instructions and are shared through unlisted, expiring links rather than published, most reports are resolved by revoking a single link.

5. 05Counter-notice

   If your material was removed and you believe that was a mistake or a misidentification, send a counter-notice to the same address. Under 17 U.S.C. § 512(g)(3) it must include:

   • your physical or electronic signature;
   • identification of the material and where it appeared before removal;
   • a statement under penalty of perjury that you have a good faith belief it was removed by mistake or misidentification;
   • your name, address and telephone number, and consent to the jurisdiction of the federal court for your district (or, if you are outside the US, for Wyoming), and to accept service from the person who filed the notice.

   We forward a valid counter-notice to the original complainant. If they do not tell us within 10 business days that they have filed an action seeking a court order, we may restore the material in 10 to 14 business days.

6. 06Repeat infringers

   We terminate the accounts of repeat infringers in appropriate circumstances, as § 512(i) requires. Repeated uploading of material you do not have rights to is also a breach of the Acceptable Use Policy, and termination for breach carries no refund.

7. 07Trade marks and other rights

   For trade mark, right of publicity, or other non-copyright complaints, write to support@carepath.com with the right you hold, evidence of it, the material at issue and where it appears. We handle these on the same timeline.
